Illegal occupants of non-Majrua land will be evicted in Bihar

After the completion (समापन) of the special land survey, people occupying (कब्जे) non-majrua common or general land without valid documents will also be evicted (निकाला हुआ).  The personnel engaged in the survey are currently making a list of such land and its illegal owner.  There is also a provision (प्रावधान) in the Bihar Special Survey and Settlement Act.  Such settlement of non-majrua land, which has not been done by order of the competent (सुयोग्य) authority, will be cancelled.  After the abolition (उन्मूलन) of zamindari, the right of settlement of such land remained with the state government only.

Surveyors have been instructed not to accept any person claiming non-Majrua land on the basis of a receipt or lease issued by any unwanted (अवांछित) authority.  Do not enter it in Jamabandi.  Write it as government land in Khanapuri.  Give its written details in the maintenance of Khesra register.  Patta, Hukumanama and rent receipts given by the ex-zamindar or intermediary will not be valid.

Surveyors will also see whether non-majrua common land is being used for residential premises.  If the land is recorded as illegal possession in Cadastral or Revisional Survey Khatian, then illegal possession will be written in the survey.  Such land of this category (which is being used as road, drain (नाली) , river, Zilla Parishad road, cremation ground (श्मशान घाट) , graveyard, school, pond (तालाब), pokhara, reservoir etc.) will be recorded in the account of non-majrua mango.

Illegal rent receipt is also invalid: In the instructions issued for the survey, it has been said that if any officer or employee has deducted the rent receipt for non-majrua common category land, it will also be invalid.  Jamabandi made on this basis will also be cancelled.  His account will not be opened in the name of any person or organization.  It will be recorded in the account of government land.  It is expected that the government will get a large area of land in rural areas.

Only government endowment will be recognized

After the abolition of zamindari, the right of settlement of non-majrua common land became vested in the government.  The settlement of this land is done in the name of any person or institution only with the approval of the Council of Ministers and the order issued on that basis.  In 2010, under this right, it was decided to give three decimals of land to the landless Mahadalits for housing in rural areas.  Divisional commissioners are authorized for this.
